    40CFRPart370 Sections311and312ofTitleIIIoftheSuperfundAmendments&ReauthorizationActof1986 ("SARATitleIII")addressemergencyandhazardouschemicalinventoryreporting.The implementingregulationsarecodifiedin40CFRpart370.Theregulationsareintendedto providethepublic,localgovernments,firedepartmentsandotheremergencyofficialswith informationconcerningthepotentialchemicalrisksintheircommunities.Over6000facilitiesin MichigansubmithazardouschemicalinventoriestotheMichiganSARATitleIIIProgram,Local EmergencyPlanningCommittees(LEPCs),andlocalfiredepartments. OnNovember3,2008,EPA published amendmentstothehazardouschemicalinventory requirementsintheFederalRegisterthattookeffectonDecember3,2008.The amendmentscodifiedexistingpoliciesandinterpretations,re-wrotetheregulationsinplain language,removedtheTierOneandTierTwoinventoryformsandinstructionsfromthe regulations, andclarifiedthereportingofmixtures.Thechangesalsoincludereportingthe NorthAmericanIndustryClassificationSystem(NAICS)codeinsteadoftheStandard IndustrialClassification(SIC)code.
    Who Must Submit the Hazardous Chemical Inventory Report
    Thesereportingrequirementsapplytoanyfacilitythatmustmaintainamaterialsafetydata sheet(MSDS)inaccordancewiththeOccupationalSafetyandHealthAdministration(OSHA) HazardCommunicationStandard,29CFR 1910.1200.     What Hazardous Chemicals Are Included
    The criteria for chemicals to be included in the section 311 report are the same as the criteria for including chemicals in the section 312 report. Hazardous chemicalsarethosechemicalsorsubstances storedorusedintheworkplacefor whichOSHArequiresemployerstomaintainMSDSs.Over650,000productshaveMSDSs requiredbyOSHA.Theyarereferredtohereas"OSHAhazardouschemicals."Thereisno list oftheseOSHAhazardouschemicals.TheOSHAhazardouschemicalsmusthavean associated physicaland/orhealthhazardasdefinedintheOSHAregulationsin29CFR 1910.1200(c).

    Physical and Health Hazards
    ThephysicalandhealthhazardswillbedescribedontheMSDS.Manynon-hazardous substancesalsohaveMSDSs.CheckyourMSDStoseeifthesubstancehasassociated physicaland/orhealthhazards.IfasubstanceisnothazardousaccordingtotheOSHA definition,theMSDS shouldstatethatthereare "noknownhazards."Ifthe MSDSdoesnotclearly describethehazards, contactthemanufactureror importerofthesubstance forclarification.Itistheir responsibilitytodetermine thehazardsinaccordance withOSHAstandardsand providethatinformationin theMSDS.Usethe NationalFireProtection Association(NFPA) numerichazardratingand thehazardcategory descriptiontohelpyou determinewhetherornot anMSDSisdescribinga hazardoussubstance.     Flammable,combustibleliquid,pyrophoric,andoxidizer.Flammable liquidshaveaflashpointbelow100°F(37.8°C).Flammablesolidsare solidsthatareliabletocausefirethroughfriction,absorptionofmoisture, spontaneouschemicalchange,orretainedheatfrommanufacturingor processing,orthatcanbeignitedreadilyandwhenignitedburns vigorouslyandpersistently.Combustibleliquidshaveaflashpointator above100°F(37.8°C)andbelow200°F(93.3°C).Apyrophoricmaterial canspontaneouslyigniteinair.Anoxidizerinitiatesorpromotes combustioninothermaterials.     Reporting Thresholds
    Thethresholdsrefertothetotalamountofchemicalonsite,instorageandinprocess,atany onetime.Theminimumthresholdsforreportingare: Extremelyhazardoussubstance(EHS)=500 pounds orthe threshold planning quantity (TPQ),whicheverisless.TheamountofanEHSatafacility(bothpureandinmixtures) mustbeaggregatedforpurposesofthresholddetermination.IncludetheEHSinamixtureif itmakesupatleast1%ofthemixture,or0.1%iftheEHSisacarcinogen.EHSsandtheir TPQsarelistedinAppendixA. Gasoline(allgradescombined)atretailgasstationsifallgasolineisstoredincompliant undergroundstoragetanks(UST)=75,000 gallons.Thetermgasolineincludesgasohol whichiscomposedofatleast90%gasolineandupto10%ethanol.* Dieselfuel(allgradescombined)atretailgasstationsifalldieselfuelisstoredincompliant undergroundstoragetanks=100,000 gallons.* AllotherOSHAhazardouschemicals(exceptasstatedinthenextbullet)=10,000 pounds. ThethresholdforreportinginresponsetoarequestfromtheSERC,LEPC,orlocalfire department=zero.Regardlessoftheamountofchemicalonsite,youmustsubmitareport ifyouareaskedtodosobyoneoftheseagencies. *Retailgasstationsarethosethatsellgasolineand/ordieselfuelprimarilytothepublicfor motorvehicleuseonland.Tanksarecompliantifduringthefullpreviousyeartheywere incompliancewithallapplicableUSTrequirementsintheMichiganUnderground StorageTankrulespromulgatedpursuanttopart211ofPublicAct451.Thehigher gasolineanddieselfuelthresholdsdonotapplytoalternativefuels(exceptgasohol), aviationfuel,heatingfuel,kerosene,E-85,orgasolinewithgreaterthan10%ethanol. Thethresholdsformostsubstancesareinpounds.Whatifyoursubstanceisaliquidandyou onlyknowthenumberofgallons Youwillneedtoconvertgallonstopoundsbyusingthis formula: Specificgravityofproductx8.34lb/gal(weightofwater)=weightofproductinlb/gal Thespecificgravity(alsocalledtherelativedensity)canbefoundinthe"Physical&Chemical Properties"sectionoftheMSDS.Itisaunit-lessnumberthattellshowmuchthesubstance weighsrelativetotheweightofwater.Ifthespecificgravityis1,thesubstanceweighsthe sameaswater.Ifitislessthan1,thenthesubstanceweighslessthanwater.Thespecific gravityisoftenreportedasarange.Usethehighestvalueinthecalculation.
    What Chemicals Are Excluded
    Section311(e)ofSARATitleIIIexcludesthefollowingsubstancesfromthehazardouschemical inventoryreportingrequirementsinsections311and312: Anyfood,foodadditive,coloradditive,drug,orcosmeticregulatedbytheFoodandDrug Administration.

    Anysubstancepresentasasolidinanymanufactureditemtotheextentexposuretothe substancedoesnotoccurundernormalconditionsofuse.** Anysubstancetotheextentitisusedfor personal,family,orhouseholdpurposes,oris presentinthesameformandconcentrationasa productpackagedfordistributionandusebythe generalpublic. Anysubstancetotheextentitisusedina researchlaboratoryorhospitalorothermedical facilityunderthedirectsupervisionofa technicallyqualifiedindividual. Hazardous wastethatiscovered bytheResourceConservationand Recovery Act(RCRA)isnot regulatedbyOSHAandis thereforeexempt. However,inthe interestofemergency preparedness,youareurgedto report any hazardous wastesthat meetthereportingthreshold.
    Anysubstancetotheextentitisusedinroutineagricultural operationsorisafertilizerheld forsalebyaretailertotheultimatecustomer. **UnderEPA'snewinterpretation,publishedJuly13,2010,facilitieswillonlyhaveto includeandcounttheamountoffumeordustemittedorreleasedfromamanufactured solid that is being modifiedtodetermineiftheSARATitleIIIsections311and312 reportingthresholdshavebeenreached.Thisinterpretation appliestometal,bricks,and anyothermanufacturedsoliditemthatundergoesamodificationprocess.Itdoesnot applytoleadinbatteries.
    Hazardous Chemical Inventory Reports
    Chemicalscanbereportedaspuresubstances,asmixtures,orasthetotalquantityofa chemicalatthefacility(addingtogethertheamountspresentasacomponentinmixturesandall otheramountsofthechemical).Similarsubstancescanbegroupedifappropriate.Thereporting optionshouldbethesameinboththeinitialandannualreports. Howyoureportyourchemicalsdependsonwhatformatisofmostvaluetotheplannersand responders. Ifyouarereportingforawarehousewith100differentproductsthatallcontainthe sameflammablebaseingredient,reportthebaseingredient.Ifyouhave5differentcolorsof enamelpaint,groupthemandreportenamelpaint.Likewise,differentgradesofgasolineshould becombinedandreportedas"gasoline."Ifyouhaveaplatingsolutionthatcontainsbothsulfuric acidandnitricacid,reporttheplatingsolutionasamixture,andusetheoptiontoreportthe mixtureingredientsontheTierTworeport. ThepurposeoftheinitialreportrequiredunderSection311istoletstateandlocalofficials knowthatyourfacilityrecentlyacquiredOSHAhazardouschemicalsthatareonsiteinamounts equaltoorgreaterthanthethresholds.ThisinitialreportissometimescalledtheMSDSreport. Initialreportsshouldbefiledonlyfor newsubstancesthatmeetorexceedthethresholdand thatarenotalreadyincludedintheTierTworeportofhazardouschemicals. TheinitialreportconsistsofeithercopiesoftheMSDSsoralistoftheOSHAhazardous chemicals.Ifyousubmitalist,thenthelistmustidentifythechemicalorcommonnameofeach

    substanceasitappearsontheMSDSandtheapplicablehazardcategories.Tradenames shouldnotbeused.
    Annual (Tier Two) Report
    Thepurposeoftheannualreportrequiredundersection312istoprovidestateandlocal officialsandthepublicwithspecificinformationonhazardouschemicalsthatwerepresentat yourfacilityatanytimeduringthepreviouscalendaryearatlevelsthatequaledorexceeded thethresholds.TheannualreportistheTierTwoEmergencyandHazardousChemical Inventoryreport,orTierTworeport. Michigan does not support the Tier One form for submittal of the hazardous chemical inventory report. If you submit a Tier One report, you will be asked by the SERC, LEPC, or local fire department to submit a Tier Two report instead. You will have 30 days in which to submit the requested report to all agencies. TheTierTworeportisacertifiedreportthatcontainsspecificsaboutthefacilitylocation,the owneroroperator,emergencycontacts,andotheridentifyinginformation.Italsodescribeseach reportablechemical,andincludestheamountthatwasonsiteduringthepreviousyear,whereit waslocated,andhowitwasstored.SitemapsandMSDSscanbeattachedtotheTierTwo reporttoclarifythereportedinformation.
    Where to Submit the Reports
    TheInitialandAnnualreportsmustbesubmittedtoALLofthefollowingagencies: 1. TheMichiganSARATitleIIIProgram–onlinein TierIIManager. 2. YourLEPC–onlineorinhardcopy. 3. Thefiredepartmentwithjurisdictionoveryour facility–onlineorinhardcopy. TheMichiganSARATitleIII Programacceptsallreportson behalfoftheStateEmergency ResponseCommission(SERC).
    LEPCsandfiredepartmentsinthecountiesofIngham,Kent,Oakland,Ottawa,andWaynecan receivethereportsonline.Youmustsend a paper copy to all other LEPCs and fire departments. AddressesforLEPCsareavailableatwww.michigan.gov/sara.
    Due Dates

    TheInitial(MSDS)reportmustbesubmittedwithin 3 monthsafterthechemicalthresholdis firstmetorexceeded. TheAnnual(TierTwo)reportmustbesubmittedannuallybetweenJanuary1andMarch 1.
    TheLEPCmayaskafacilityowneroroperatortosubmitanMSDSforahazardous chemicalpresentatthefacility.TheowneroroperatormustprovidetheMSDSwithin30 daysafterreceiptoftherequest. TheSERC,LEPC,orfiredepartmenthavingjurisdictionoverthefacilitymayaskafacility owneroroperatortosubmitTierTwoinformation.Theowneroroperatormustprovidethe TierTwoinformationwithin30 days afterreceiptoftherequest.

    Confidential and Trade Secret Information
    Confidential Location Information
    Undersection324ofSARATitleIII,youarenotrequiredtomakechemicalstoragelocation informationavailabletothepublicifdoingsomightposeasecurityrisk.Thechemicallocation includesthecontainertype,temperature,pressure,andlocationdescription.Youmaynot withholdthisinformationfromtheSERC,theLEPC,orthelocalfiredepartment.Theonline reportingprogramletsyouidentifywhichchemicallocationsshouldbekeptconfidential.You mayalsomarkattachments,suchassitemaps,asconfidential.
    Trade Secrets
    Youmaybeabletowithholdthenameofaspecificchemicalwhensubmittinginformationunder sections311or312ifthatchemicalnameisclaimedasatradesecret.Therequirementsfor withholdingtradesecretinformationarespecifiedinSARATitleIIIsection322andimplemented in40CFRpart350.Ifyouarewithholdingthenameofaspecificchemicalorproductasatrade secret,youmustreportthegenericclassorcategorythatisstructurallydescriptiveofthe chemical(e.g.listtoluenediisocyanateasorganicisocyanate)alongwithallotherrequired information.YoumustsubmitthewithheldinformationtoEPAandsubstantiateyourclaimevery timeyoureport.ThereisalinktotheTradeSecretSubstantiationFormandinstructionsunder theResourcestabintheonlinereportingprogram,oryoucangoto www.epa.gov/emergencies.
    Online Reporting
    Michiganbeganusinganonlinereportingprogram,TierIIManager,inAprilof2007sothat thedatawouldbemorereadilyavailabletoplanners(LEPCs)andresponders(fire departments).Theonlineprogramallowsfacilitiestomanagetheirowndataandenterupdates atanytimeduringtheyear.TheTierTworeportisasnapshotofthedatathatiscertified annuallyasbeingtrue,accurate,andcomplete. Theonlinedatabasewaspre-loadedwithdatafromfacilitiesforwhichreportsweresubmittedto theMichiganSARATitleIIIProgrambeforeJanuary2007.AllTierTworeportsreceivedfor reportyears2001through2005wereimportedintotheonlinedatabase.Informationfromthe mostrecentreportwasusedtopopulatetheeditabledatabase.     Community Right-to-Know Provisions
    HazardouschemicalinventoryinformationisavailabletothepublicundertheCommunityRightto-KnowprovisionsinSARATitleIII.RequestscanbemadeinwritingtotheLEPCorSERCas describedbelow.Thepublicshouldnotgotothefacilityortothefiredepartmentwith informationrequests.TheMichiganSARATitleIIIProgramhandlesallinformationrequestson behalfoftheSERC.AddressesfortheMichiganSARATitleIIIProgramandtheLEPCsare postedontheMichiganSARATitleIIIProgramwebsite. ApersonmayobtainanMSDSforaspecificchemicalataspecifiedfacilitybywritingtothe LEPCandaskingforit.IftheLEPCdoesnothavetheMSDS,theLEPCmustrequestthe MSDSfromthefacility'sowneroroperator. ApersonmayrequestTierTwoinformationforaspecificfacilitybywritingtotheSERCorLEPC andaskingforit.TheSERCorLEPCmustrespondtoarequestforTierTwoinformationwithin 45daysafterreceivingtherequest.     Local Fire Department Requests
    Ifyouaretheowneroroperatorofafacilitythathassubmittedinventoryinformationunder sections311or312,youmustcomplywiththefollowingtworequirementsuponrequestbythe firedepartmentwithjurisdictionoveryourfacility: 1. Youmustallowthefiredepartmenttoconductanon-siteinspectionofyourfacility;and 2. Youmustprovidethefiredepartmentwithinformationaboutthespecificlocationsof hazardouschemicalsatyourfacility.

    Certification

Enterofthenameandofficialtitleoftheowneroroperatorortheofficiallydesignated representativeoftheowneroroperatorwhocanandwillcertifythattheinformationinthereportis "true,accurateandcomplete."
