Hong Kong Harmonized System (HKHS), used principally for import and export declaration purpose, has undergone major updating since 1 January 2012. Import/export declarations for shipments on or after 1 January 2012 must be completed using commodity codes and units of quantity in accordance with the 2012 Edition of the HKHS. Background 1.1 「货物名称及编号协调制?」 (简称「协调制?」),是由世界海关组织制订的多种用途货物分?制?,可供海关及统计当局、进出口人士、运输业及其他与国际贸?有关的人士及机构采用.超过 200 个国家和经济体系已采用这系统,作为徵收关税和编制国际贸?统计 ?據的基础.香港已於一九九二?一月一日起,全面采用协调制?作贸?报关之用. 1.1 The Harmonized Commodity Description and Coding System, or the Harmonized System (HS), is designed by the World Customs Organization (WCO) as a multi-purpose classification system of commodities suitable for use by customs and statistical authorities, importers/exporters, carriers and others involved in international trade. The system is used by more than 200 countries and economies as a basis for their Customs tariff and for the compilation of international trade statistics. Hong Kong has adopted the HS in full for trade declaration purposes since 1 January 1992. 1.2 世界海关组织所制订的协调制?是一个层次式的货物分?及编号制?.个别货品由? 个位编号代表,其中首?个位编号表示该货品在协调制?内所属的「章」,首四个位编号表示该货品所属的「项」,而整个?位编号则表示所属的「分项」.?如,母鸡属於分项 0105 94「雉科家禽」内,而该分项则为第一章「活的动物」内0105 项「活家禽」以下的其中一个分项. 1.2 The HS designed by the WCO is a hierarchical system of commodity classification and coding. Each commodity is identified by a 6-digit HS code, in which the first two digits denote the "chapter" in the HS under which the commodity is classified, the first four digits denote the "heading" and the whole six digits denote the "subheading". For example, hens are classified in subheading 0105 94 "fowls of the species Gallus domesticus", which is under heading 0105 (live poultry) in Chapter 1 (live animals). 1.3 协调制?规定以?位编号分项为货物的分?,作为国际间比较的标准.个别国家/地区亦可依照本身的特定需要,增添货物编号的位?,以作?详细的货物分?.「香港货物协调制?」(简称「港货协制」)采用合共八位编号的货物分?系统,其中首?位编号是全面采用世界海关组织制定的协调制?,加添的第七及第八位则用作?详细的货物分?,以配合本地需要. 1.3 While the HS specifies the commodity classification up to 6-digit subheading level for international comparison, individual countries/territories are free to use additional digits for more refined classification to meet their specific local needs. The Hong Kong Harmonized System (HKHS) uses an 8-digit classification system with the first six digits complying fully with the HS designed by the WCO; and the additional 7th and 8th digits meeting requirements for more detailed commodity classification in Hong Kong. 1.4 中华人民共和国香港特别?政区基本法内注明,香港特别?政区为单独的关税地区. 香港具备本身的货物编号,与中国内地贸?报关使用的详细分?编号?尽相同,但?者的首 ?位编号则是共通的.尽管有?同的关税系统,但近?香港与中国内地的贸?关系越趋紧 1.4 As stated in the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China, Hong Kong Special Administrative Region is a separate customs territory. Hong Kong has its own commodity classification which is different from the detailed classification for trade declaration in the mainland of China; but both 香港统计月刊二?一二?二月 FC2 Hong Kong Monthly Digest of Statistics February 2012 密.一项主要的发展是自二??四?一月一日起实施的《内地与香港关於建??紧密经贸关系的安排》(《安排》).在《安排》下,附有《安排》下原产地证书的港制货物,从香港出口往中国内地时,可享有?关税优惠.双方同意自二????起,每?按业界提出的申请作 ?次检讨,以增加《安排》涵盖的货物项目. 「港货协制」亦须配合这发展而进?相应修订. are fully compatible up to the 6-digit level. Notwithstanding the separate customs systems, trade relations between the mainland of China and Hong Kong have become increasingly close in recent years. A major development is the implementation of the Mainland and Hong Kong Closer Economic Partnership Arrangement (CEPA) which has come into effect since 1 January 2004. Under CEPA, exports to the mainland of China can claim zero tariff if the consignment is accompanied by a CEPA Certificate of Hong Kong Origin. Both sides have agreed to review the applications by traders twice a year since 2006, with a view to enriching the coverage of commodity items under CEPA. The HKHS has to be amended accordingly to cope with this development. 2. 港货协制的按?修订 2. Annual Amendment on the HKHS 2.1 政府统计处每?均會根據贸?模式及科技方面的重大改变、本地及国际规定和《安排》的发展,?新港货协制. 2.1 Each year, updating of the HKHS is made by the Census and Statistics Department (C&SD) to take account of significant changes in trade pattern and technology, local and international requirements, and development of CEPA. 2.2 本处每?修订港货协制时 , 會把为?配合《安排》的最新发展所需的改动适当地并入港货协制内.对於《安排》所涵盖货物的港货协制的修订,主要是把现有的港货协制八位编号分拆为?详细的分项,使中国内地与香港在货物分?方面?为协调. 2.2 The required changes in the HKHS to cope with the latest development in CEPA would be suitably incorporated during each annual amendment exercise. Amendments to the HKHS for commodities covered by CEPA are mainly achieved through splitting the existing 8-digit HKHS item codes into more detailed breakdowns, with a view to achieving greater harmonization between commodity classifications of the mainland of China and Hong Kong. 2.3 在二??九? , 世界海关组织建议对协调制?作出 220 项的修订,并要求各《协调制? 国际公约》的缔约成员在二?一二?一月一日起实施该修订.为?确保香港的货物分?制? 能继续与其主要贸?夥伴一致,香港亦於二? 一二?一月一日起实施该修订. 2.3 In 2009, the WCO recommended 220 sets of amendments to the HS. Contracting parties to the International Convention on the HS were required to adopt these amendments as from 1 January 2012. To ensure that Hong Kong's commodity classification system continues to be compatible with those of its major trading partners, Hong Kong has also implemented these amendments with effect from 1 January 2012. 香港统计月刊二?一二?二月 FC3 Hong Kong Monthly Digest of Statistics February 2012 2.4 相对於惯常的按??新工作 , 是次?新涉及较多货物条目和进出口人士,因此必须详细策划和准备,确保修订顺?进?.港货协制二 ?一二?版的筹备工作早於二?一??十月开始进?. 2.4 The number of Commodity Items involved and number of importers/exporters affected for the 2012 round updating were much more substantial than those in the regular annual updating exercise. Hence, detailed planning and sufficient preparatory work were required to ensure a smooth implementation. Preparatory work for implementing the 2012 Edition of the HKHS started in October 2010. 3. 谘询机制 3. Consultation Mechanism 3.1 政府统计处在二?一一?三月至四月进 ?谘询,收集进出口人士、商會、贸??據使用者及各政府部门对港货协制的建议修订的意 ?. 3.1 Consultation with importers/exporters, trade organisations, users of trade statistics and government departments was conducted by C&SD during March 2011 to April 2011, the purpose of which was to solicit their comments on the proposed amendments for the HKHS. 3.2 在为期约一个月的谘询期 , 政府统计处在部门网站邀请公众对修订提供意?.期内亦通知所有使用进/出口报关单及货物舱单查询热线的人士,可透过传真?取相关谘询的文件. 3.2 The consultation exercise lasted for around one month, during which invitation for suggestions on amendment was also posted on the C&SD website for access by the general public. Furthermore, notification was made under the Import/Export Declaration and Cargo Manifest Enquiry Hotline to all incoming enquirers during the consultation period on the availability of consultation document through the fax-on-demand service of the Hotline. 3.3 商业机构和有关政府部门的意?和回应,对修订当时建议的港货协制二?一二?版均十分有用.透过谘询收集得到的意?會予以整合及考虑,本处尤其关注进出口人士在按照经修订的货物分?制?报关时會否遇到困难. 完成谘询后,港货协制二?一二?版於二?一一?九月定稿. 3.3 The comments and feedback from the business sector, together with those obtained from relevant government departments, provided useful inputs for refining the then proposed 2012 Edition of the HKHS. Suggestions received from consultations were consolidated and considered. Particular attention was given to ascertaining whether importers/exporters would have difficulties in lodging declarations in accordance with the changes in commodity classification. The 2012 Edition of the HKHS was finalised in September 2011 after completion of the consultation process. 香港统计月刊二?一二?二月 FC4 Hong Kong Monthly Digest of Statistics February 2012 4. 港货协制二?一二?版的主要修订 4. Major Amendments in the 2012 Edition of the HKHS 4.1 港货协制二?一二?版的修订,主要涉及以下部分: ? 农业部分 ? 化学部分 ? 纸制品部分 ? 纺织原?部分 ? 贱?属部分 ? 机械部分 4.1 Amendments incorporated into the 2012 Edition of the HKHS mainly involve the following sectors: ? agricultural sector ? chemical sector ? paper sector ? textile sector ? base metal sector ? machinery sector 这些修订反映?以下方面的变动和发展: These amendments reflect changes and development in the following aspects: (i) ?食安全的关注 (i) Concerns on food security 由於?合国?食及农业组织,就那些对? 食安全和早期预警方面较为重要的货品,采用协调制?作为基础进?分?及编码,所以在食品和农产部分(协调制?的第一至二?)进??较大?的修订.修订中已新增分项以分辨某些品种的鱼?、甲壳动物、软体动物和其他水生无脊椎动物;亦已新增分项以分辨某些可食用蔬菜、根茎、水果及硬壳果和谷物. The Food and Agriculture Organization of the United Nations (FAO) has used the HS as standard in classifying and coding commodities of specific importance to food security and the early warning system on food and agriculture. The volume of amendments made to food and agricultural sectors (Section I-II of HS) are therefore quite substantial. New subheadings have been created for the separate identification of certain species of fish and crustaceans, molluscs and other aquatic invertebrates; and for the separate identification of certain edible vegetables, roots and tubers, fruit and nuts, as well as cereals. Many amendments are related to the protection of the environment, including the creation of new subheadings 2903 71 to 2903 75 to facilitate the monitoring of ozone-depleting substances controlled under the Montreal Protocol; and the creation of new subheadings for certain hazardous chemicals and pesticides controlled under the Rotterdam Convention, such as subheading 2908 92 for 4,6-Dinitro-o-cresol (DNOC(ISO)) and its salts. 香港统计月刊二?一二?二月 FC5 Hong Kong Monthly Digest of Statistics February 2012 (iii) 贸??的变动 (iii) Change in trade volume? 对贸?总?较低的商品分项进?合并或删除,从而简化港货协制.另一方面,就贸??相当的产品新增分项,?如百合花、蔓越橘及蔓越橘汁、水烟筒烟丝和木 ?. Some subheadings are deleted or combined on account of low volume of trade with a view to simplifying the HKHS. On the other hand, new subheadings are created for those products with significant trade volume, such as lilies (Lilium spp.), cranberries and cranberry juice, water pipe tobacco and wood pellets. (iv) 科技的发展 (iv) Technological development 随著科技的演变,市场上有?少新产品推出.配合这方面的发展,为生物柴油新增项目 3826,亦修订项目 3002"免疫产品"的定义及其相关的章注释. Alongside with technological progress, new products have been launched in the market. To cope with this trend, new heading 3826 has been created for biodiesel. Amendments have also been made to the chapter note in defining immunological products under heading 3002. (v) 《安排》的发展 (v) Development of CEPA 举???,为配合《安排》第九阶段的实施,在港货协制二?一一?版的条目 2309 1000 所指供?售的狗或猫饲?已在二?一二?版细分为?个?同条目,分别为条目 2309 1010–罐头狗或猫饲?和条目2309 1090–其他供?售的狗或猫饲 ?. For example, item code 2309 1000 for dog or cat food, put up for retail sale in 2011 Edition of the HKHS has been split into two different item codes in 2012 Edition to cope with the implementation of CEPA Phase IX, including item code 2309 1010 for canned dog or cat food and item code 2309 1090 for other dog or cat food, put up for retail sale. To ensure the uniform interpretation and application of the HS, amendments have been made to some section notes, chapter notes, heading notes, subheading notes and textual descriptions so as to further elaborate and specify the coverage of products for certain item codes to reduce confusion. Publicity Activities of 2012 Edition of the HKHS 5.1 香港是一个自由港,有很多从事进出口业务的人士.因此,有必要广泛宣传,让进出口人士清楚知道港货协制二?一二?版的变动.在这方面,统计处於二?一一?十月至二 ?一二?三月期间进?一??宣传活动,加强进出口人士对港货协制二?一二?版的认?. 5.1 While Hong Kong is a free port with a large number of persons involved in import and export business, extensive publicity activities have to be organised to ensure that importers/exporters are well informed of the changes in the 2012 Edition of the HKHS. In this regard, a series of publicity activities is launched from October 2011 to March 2012 to enhance the awareness of importers/exporters about the 2012 Edition of the HKHS. 5.2 相关的宣传活动包括於二?一一?十一月十四日发出新闻稿、透过报关事宜查询热线作出宣传及邮寄进出口报关须知予约 13 000 个受影响的进出口人士.有关修订事宜已於二 ?一一?十一月十一日刊登宪报. 5.2 These publicity activities include the issue of a press release on 14 November 2011; making announcement in the Import/Export Declaration and Cargo Manifest Enquiry Hotline and mailing Notice on Lodgement of Import and Export Declaration to some 13 000 affected importers and exporters.
